- This monograph (268 pages, including bibliography) is the result of sustained research and writing over a period of nine years. The monograph reports the results of interviews with 25 serving Scottish judges, examining judicial perceptions of, and attitudes towards, the sentencing process. Through these interviews, and by presenting a comprehensive review and analysis of recent scholarship on sentencing – including a comparative study of UK, Irish and Commonwealth sentencing jurisprudence – the book presents a systematic theory of sentencing. It remains the only empirical study of Scottish sentencing in recent years, the last such study having been published in 2004.
