It is based on PhD research that began in 2010 and was subsequently fully revised and updated between 2014-2016. It provides a systematic comparative analysis of an area of law that has now been subject to considerable litigation and law-making, across three jurisdictions, England and Wales, Canada and the USA, in a way which had not previously been achieved.
