- The monograph undertakes a rigorous examination of the complete case-law of the European Court of Human Rights concerning sexuality and gender identity. It makes use of ‘queer theory’ to provide a theoretically-grounded exploration of the discursive construction of sexual and gender identities through international human rights law. Engaging with the tension between (postmodern) queer theory and (liberal) human rights law, the monograph not only highlights theoretical confrontations, but also proposes potential ways to overcome them by revealing how even the most conservative judicial decisions have (inadvertently) challenged some of the most frequently assumed ideas about gender, sexuality and kinship.
