- This book is based on a study spanning four years, bringing together a range of empirical, comparative and historical sources to analyse the impact of prenuptial agreements. It develops a new theory, arguing for an alternative approach that appreciates the gendered power imbalances commonly affecting these agreements. The book’s analysis of both prenups and contract law was applied by Australia’s highest court in the key passage of its leading prenups case. This not only changed the law on prenups in Australia; it also influenced a wide range of contract and property transaction cases, demonstrating the breadth of the book’s analysis.
