- Notwithstanding ‘the systematic dismantling of the common law of conflict of laws’ by the ECJ / CJEU, the UK chose to opt in to the adoption of the Brussels Ia Regulation. This paper analyses the UK approach to anti-suit injunctions in domestic case law implicating Brussels I, as well as its negotiating position as regards the Recast in light of the terms of Protocol 21 TFEU. Consideration is then given to the potential impact of the Recast on anti-suit injunctions, in particular through the re-enforcement of party autonomy and new rules on parallel proceedings involving third States.
