- The chapter analyses the Brexit process comprehensively from UK and EU perspectives, covering its causes, the procedure under Article 50 TEU, and the outcome in the Withdrawal Agreement and Political Declaration that sealed the UK’s exit in January 2020. It argues that Article 50 TEU is flawed, requiring both teleological interpretation in the light of EU values (especially the rule of law) and, ultimately, reform. It also analyses how UK law implements the Withdrawal Agreement, potential crunch points in reaching a EU/UK Free Trade Agreement, and the possible EU response to the phenomena which contributed to Brexit.
