- This book first provides a critical analysis of the pre-pack approach to corporate rescue adopting the law and economics analysis on this hybrid rescue process. Secondly, the book offers an in-depth comparative analysis of the corporate rescue mechanisms. It examines the standards the US courts apply in s 363 pre-plan sale and the pre-pack and equivalent mechanisms in select European jurisdictions.
