- Whether fundamental rights should be applicable vertically or vertically and horizontally (i.e. against the state and some or all private actors) is a key question for all modern constitutional democracies. This book is the first monograph on the horizontal effect of fundamental rights in the EU, forming part of OUP’s landmark series on contemporary studies in EU law. It merits double-weighting not only because of its breadth (spanning 110,000 words) but also because it offers an argument for resolving current inconsistencies in relevant EU case law by drawing upon perspectives from political theory and offering an overarching normative framework.
