- Early ideas for Chapter 1 of this book were previously published in ‘Presumptions on the Law Governing the Incorporation of Forum Selection Clauses: Should the Putative Applicable Law Lead the Way?’ (2011) 4 JBL 357 (submitted to REF2014). The previous article analysed the incorporation of forum selection clauses in charterparties into bills of lading. Some of this analysis is picked up in 10 pages of Chapter 1 (pp 22-25, 26-29 and 31-32). Chapter 1 develops this earlier analysis and incorporates significant new material. Beyond Chapter 1, the book comprehensively analyses all legal issues concerning the incorporation of charterparties.
