- This monograph is a result of 7 years spent researching European Consensus in the jurisprudence of the European Court of Human Rights (ECtHR). It addresses a topic that has not previously been considered in a full-length volume. It analyses a substantial body of material, including over 300 cases, and is informed by 33 interviews with judges of the ECtHR, while the internal workings of the ECtHR are explored via field research at the Court. Relevant secondary literature was reviewed in order to apply the theory of legitimacy of courts to the ECtHR’s reliance on European consensus.
