- This book is the first work in English that involves a comprehensive study of the party autonomy principle in Chinese private international law. It looks at the operation of the principle from a practical perspective, including a detailed analysis of the several stages involved in the determination of the enforceability of choice of law clauses. Through an examination of over seventy cases, it reveals the discrepancy between the legal rules and the relevant judicial practice. On that basis, the book touches upon problems more generally relating to the legal system in China, and provides insights into the recent judicial reform.
