- Stepfamilies raise specific inheritance related questions for which adequate solutions need to be found. Both French and English succession laws aim to strike a balance between the deceased’s wishes, and the interests of the surviving spouse and other family members. However, the French law model gives defined and substantial shares to close family members of the deceased, whereas the English judge’s discretionary powers offers more flexibility in this respect. This article analyses and compares the two approaches and proposes critical reflections to inform and move forward the discussions in both countries.
